Wills for Young Families

Dear PDX Kids Calendar Reader,

When my daughter was 7 months old, I created a set of wills for our family. As the father of a young child, I know the concerns young families have about their future and I am in touch with the needs of young parents. Let me help you protect your family by planning for your future.

We all want the best for our children, and we work hard to provide this while we are a part of their life. Unfortunate and unplanned situations can arise, and you should be prepared. As a responsible parent, you should ask yourself a few key questions:

  • Who will take care of my children in the event of my death?
  • How can I make sure my children are taken care of according to my wishes?
  • How will my assets be transferred to my family?

You do not need to have a large estate to need a will. A will can benefit any family. By making important decisions now, you can keep your loved ones from dealing with unnecessary financial and emotional issues at an already difficult time.

Protect your children from an unknown future by creating a will that details who will care for your children and their property in the event of your death. By carefully choosing the right guardian for your children, instead of leaving it up to the courts to decide, you can rest assured that your children will be well cared for after you are gone. And by setting up a testamentary trust, you can protect and provide for your children after you are gone by determining what purposes their inherited property can be used for and when they receive it.

Here are a few things to think about while you're going through the process of protecting your family's future through planning for your death or incapacity:

  • Who will be the take care of your children? The person who will care for your children on a day-to-day basis after you are gone is called a guardian. There are a number of questions to ask yourself when choosing a guardian for your children. Who is financially, emotionally and physically able to care for your children? Whose parenting style, values, and religious beliefs most closely match your own? Will the person have enough time and energy to devote to your child?

  • What assets do you have? Your assets include real estate, bank accounts, investments, and life insurance, as well as, sentimental personal property which you may want to pass on to your children.

  • Who do you want to inherit your assets? Decide exactly who you want to inherit what, and when. For example, you may want your daughter to inherit her grandmother's gold bracelet when she turns 16. Or you may want money set aside for college expenses.

  • Who will handle your children's inherited property if they are too young or unable to do so themselves? If you don't want your children to inherit your property outright, you will need to choose a conservator or a trustee. Sometimes, but not always, the person you nominate as guardian of your children is the same person you choose for as conservator or trustee. A conservator or trustee should be someone who is financial responsible and who you trust to understand and follow your guidance regarding how to distribute your children's property.
